Terms and Conditions for Accommodation

Article 1 (Scope of Application)

1. Contracts for accommodation and related agreements to be entered into between this Hotel and the Guest shall be subject to these Terms and Conditions. Any matter not provided for herein shall be governed by laws and regulations and/or generally accepted practices.

2. If the Hotel has agreed to a special contract to the extent that it does not violate laws, regulations, or generally accepted practices, the special contract shall take precedence over these Terms and Conditions, notwithstanding the preceding paragraph.

Article 2 (Application for an Accommodation Contract)

1. A person who intends to apply for an accommodation contract with the Hotel shall provide the Hotel with the following particulars:

  • (1) Name(s) of the Guest(s)
  • (2) Date(s) of stay and estimated time of arrival
  • (3) Accommodation charges
  • (4) Other particulars deemed necessary by the Hotel

2. If a Guest requests, during their stay, an extension of the accommodation beyond the dates in item (2) of the preceding paragraph, the Hotel shall handle the request as a new application for an accommodation contract made at the time the request is made.

Article 3 (Conclusion of the Accommodation Contract, etc.)

1. An accommodation contract shall be deemed concluded when the Hotel has accepted the application set forth in the preceding Article. However, this shall not apply where the Hotel proves that it did not accept the application.

2. When an accommodation contract has been concluded under the preceding paragraph, the Guest shall pay an application deposit set by the Hotel, up to the amount of the basic accommodation charge for the period of stay, by the date specified by the Hotel.

3. The application deposit shall first be applied to the accommodation charges ultimately payable by the Guest. If circumstances arise to which Articles 6 or 18 apply, it shall be applied to the cancellation charge and then to compensation, in that order; any remainder shall be refunded at the time of payment of charges under Article 12.

4. If the application deposit under paragraph 2 is not paid by the date specified by the Hotel, the accommodation contract shall cease to be effective, provided that the Hotel has notified the Guest to that effect when specifying the payment date.

5. Entry to guest rooms by anyone other than registered Guests is strictly prohibited. If friends or other visitors are found to have entered a room, they will be regarded as staying guests and the prescribed accommodation charge will apply.

Article 4 (Special Contract Requiring No Application Deposit)

1. Notwithstanding paragraph 2 of the preceding Article, the Hotel may agree to a special contract requiring no application deposit after the contract has been concluded.

2. If the Hotel has not requested payment of the application deposit or has not specified its payment date when accepting the application, the Hotel shall be deemed to have agreed to the special contract in the preceding paragraph.

Article 5 (Refusal to Conclude an Accommodation Contract)

1. The Hotel may decline to conclude an accommodation contract in the following cases:

(1) When the application does not conform to these Terms and Conditions.

(2) When the Hotel is fully booked and no rooms are available.

(3) When the person seeking accommodation is deemed likely to act in violation of laws and regulations, public order, or good morals in connection with their stay.

(4) When the person seeking accommodation is clearly recognized as carrying an infectious disease.

(5) When demands beyond a reasonable scope are made in connection with the accommodation.

(6) When the Hotel is unable to provide accommodation due to natural disasters, malfunction of facilities, or other unavoidable causes.

(7) When the person seeking accommodation is likely to cause a nuisance to other guests due to intoxication or otherwise, or behaves in a manner that seriously disturbs other guests.

(8) When the person seeking accommodation is an organized crime group, a member of an organized crime group, an organization related to organized crime (including corporations) or a party related thereto, or any other anti-social force (hereinafter collectively “organized crime groups, etc.”).

(9) When the person seeking accommodation is a corporation or other organization whose business activities are controlled by, or whose officers (including key executives) include, organized crime groups, etc., or a party related thereto.

(10) When the person seeking accommodation has used violence, threats, extortion, or coercive unjust demands against the Hotel or its staff, has demanded burdens beyond a reasonable scope, or is recognized as having previously committed similar acts.

Article 6 (Right of the Guest to Cancel the Contract)

1. The Guest may cancel the accommodation contract by notifying the Hotel.

2. If the Guest cancels the accommodation contract in whole or in part for reasons attributable to the Guest (except where the Hotel has requested payment of the application deposit by a specified date under Article 3, paragraph 2 and the Guest cancels before making that payment), the Hotel shall charge a cancellation fee as set forth in Appended Table 2. However, where the Hotel has agreed to a special contract under Article 4, paragraph 1, this applies only if the Hotel informed the Guest of the obligation to pay a cancellation fee upon cancellation when agreeing to the special contract.

3. If the Guest does not arrive by 8:00 PM on the day of stay without notice (or two hours after the stated estimated time of arrival, if specified in advance), the Hotel may treat the accommodation contract as having been cancelled by the Guest.

Article 7 (Right of the Hotel to Cancel the Contract)

1. The Hotel may cancel the accommodation contract in the following cases:

(1) When the Guest is deemed likely to act, or is recognized as having acted, in violation of laws and regulations, public order, or good morals in connection with their stay.

(2) When the Guest is clearly recognized as carrying an infectious disease.

(3) When demands beyond a reasonable scope are made in connection with the accommodation.

(4) When the Hotel is unable to provide accommodation due to force majeure such as natural disasters.

(7) When the Guest is an organized crime group, a member of an organized crime group, an organization related to organized crime (including corporations) or a party related thereto, or any other anti-social force.

(8) When the Guest is a corporation or other organization whose business activities are controlled by, or whose officers (including key executives) include, organized crime groups, etc., or a party related thereto.

If no instructions are given or the owner cannot be identified, the items shall be kept for 7 days including the day of discovery and disposed of thereafter.

3. The Hotel’s responsibility for the storage of baggage or belongings in the cases of the preceding two paragraphs shall be in accordance with paragraph 1 of the preceding Article in the case of paragraph 1, and with paragraph 2 of the same Article in the case of the preceding paragraph.
